1. About Gigl
Gigl is a trading name of Nomadsec Ltd, a company registered in England and Wales (company no. 16591492). We operate a B2B marketplace platform at getgigl.co.uk that connects live entertainers with venues for booking, contracting, and payment.
By creating an account and using the Gigl platform, you agree to these Terms of Service. If you do not agree, you must not use the platform.
2. Eligibility
- You must be at least 18 years old to use Gigl.
- You must be based in the United Kingdom.
- Venue accounts must represent a legitimately operating business or venue.
- Entertainer accounts must represent a genuine performer or act.
- You must provide accurate information when creating your account and profile.
3. Gigl's Role
Gigl is a marketplace intermediary. We facilitate introductions and transactions between venues and entertainers but are not a party to the performance contract between them. Gigl is not an employer, agent, or representative of any entertainer or venue on the platform.
4. Booking Fees
Gigl charges venues a platform listing fee and a booking fee calculated as follows:
- Booking fee: 10% of the agreed artist fee, with a minimum booking fee of £10.
- The fee is displayed clearly before you confirm any booking.
- Entertainers pay no platform fee — their advertised fee is what they receive.
- All fees are non-refundable once a contract is signed, except where Gigl is at fault.
5. Payments
All payments are processed via Stripe. By making a payment through Gigl you also agree to Stripe's terms of service.
- When a venue authorises payment, the artist fee is pre-authorised (held) on their card. Funds are not taken immediately.
- The held funds are captured and paid to the entertainer automatically 48 hours after the event end time, provided no dispute has been raised.
- Entertainers receive payment directly to their Stripe Connect account. Gigl does not hold artist fees.
- Gigl is not a payment institution or e-money issuer.
6. Contracts
When a venue accepts an entertainer's application, Gigl generates a digital performance agreement. Both parties must sign independently via the platform before payment can be authorised. The signed contract is legally binding between the venue and the entertainer. Gigl retains a record of all signed contracts.
7. Check-In
Gigl uses a mutual check-in system to confirm attendance. Check-in opens 60 minutes before the event start time. Each party receives a unique 6-digit code which they must provide to the other party. Both parties must check in to confirm the gig took place. Failure to check in may affect payment release.
8. Cancellation & No-Shows
- Venue cancellation: If a venue cancels a confirmed booking, the listing fee is non-refundable. The entertainer is entitled to a cancellation fee as set out in the performance contract.
- Entertainer no-show: If an entertainer fails to check in, the pre-authorised payment is voided and no funds are taken from the venue. Repeated no-shows may result in account suspension.
- Venue no-show: If a venue fails to check in but the entertainer was present, the entertainer should raise a dispute immediately after the event.
9. Disputes
Either party may raise a dispute via the platform within 48 hours of the event end time. When a dispute is raised:
- The held funds are frozen immediately.
- Gigl will review the case, including check-in records, contracts, and any evidence submitted.
- Gigl's resolution is final and binding on both parties.
- Resolution will be communicated within 5 working days.
10. Prohibited Conduct
You must not:
- Arrange bookings or payments outside the platform with connections made via Gigl ("side-booking").
- Create fake or misleading profiles.
- Harass, threaten, or abuse other users.
- Attempt to circumvent the platform's payment or verification systems.
- Use the platform for any unlawful purpose.
Gigl reserves the right to suspend or permanently ban any account found to be in breach of these terms.
11. Reviews
Following a completed gig, both parties may leave a review. Reviews must be honest and based on genuine experience. Gigl reserves the right to remove reviews that are abusive, false, or in breach of these terms.
12. Limitation of Liability
To the fullest extent permitted by law:
- Gigl is not liable for any loss or damage arising from a venue's or entertainer's failure to fulfil their obligations under a performance contract.
- Gigl is not liable for indirect, consequential, or economic loss.
- Gigl's total liability to any party shall not exceed the booking fees paid in connection with the relevant transaction.
13. Account Deletion
You may delete your account at any time from your account settings. Your personal data will be anonymised in accordance with our Privacy Policy. Payment records are retained for 6 years as required by HMRC.
14. Changes to These Terms
Gigl may update these terms from time to time. We will notify you by email of any material changes. Continued use of the platform after changes are published constitutes acceptance of the updated terms.
15. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
